Terms & Conditions of Villa Rental


PAYMENT Preferred method by Paypal or Credit Card through Secure Site. UK cheques accepted payable to Alistair Lee.

PRICES are as detailed on the "Villa Rates" page of this web site and are confirmed at time of acceptance of a booking.

Local taxes, electricity, local telephone, pool and spa heating are fully included in the rental.


1. The property known as 1109 Cypress Pointe ("the Property") is offered for holiday rental subject to confirmation by Alistair Lee ("the Owner") to the renter ("the Client").

2. To reserve the Property, the Client should complete the booking form online and receive confirmation of availability and price. Following payment of the 15% non-refundable deposit the Owner will send a confirmation email. This is the formal acceptance of the booking.

3. The balance of the rent together with the security deposit (see clause 4) is payable not less than eight weeks before the start of the rental period. If payment is not received by the due date, the Owner reserves the right to give notice in writing and/or by email that the reservation is cancelled. From that time the Client will remain liable to pay the balance of the rent unless the Owner is able to re-let the property. In this event, clauses 5 and 6 of these booking conditions will apply. Reservations made within eight weeks of the start of the rental period require full payment at the time of confirmed availability.

4. A security deposit of 125.00 ($200.00) is required along with the final balance payment. This will be refunded to the Client as soon as possible after the property report from the management company, less the cost of any damage or extra cleaning.

5. Subject to clause 2 and 3 above, in the event of a cancellation, refunds of amounts paid, over and above the non-refundable deposit, will be made if the Owner is able to re-let the Property, and any expenses or losses incurred in doing so will be deducted from the refundable amount. This refers to the reduced price which the Property may then be let for due to late availability letting. The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the party's personal belongings, public liability etc, since these are not covered by the Owner's insurance.

6. If adequate time allows for re-letting of the Property in the event of a cancellation, the Owner will allow the non-refundable deposit to be used for a future booking of the Property.

7. Entry cannot be made before 4 p.m. on the first day of rental of the Property and the Property must be vacated by 11 a.m. on the day of your departure to enable cleaners to prepare for the next guests. The Owner shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated.

8. The maximum number to reside in the Property must not exceed 10.

9. The Client agrees to be a considerate tenant and to take good care of the Property and to leave it in a clean and tidy condition at the end of the rental period. The Owner reserves the right to make a retention from the security deposit to cover additional cleaning costs if the Client leaves the Property in an unacceptable condition. The Client agrees that our management company will determine what is deemed an unacceptable condition. The Client also agrees not to act in a way, which would cause disturbance in the neighbouring properties.

10. The Client shall report to the Owner's management company without delay any defects in the Property or breakdown in the equipment or appliance in the Property or garden, and arrangements for repair and/or replacement will be made as soon as possible.

11. Neither the Owner nor the management company will accept any liability to the Client for the following: Any accident, illness or personal damage sustained during tenancy. We especially ask parents to ensure that children are fully supervised whilst in the pool and pool area. Any temporary defect or stoppage in the supply of public services to the Property. Any fault with equipment or appliance in the property or garden. Any loss, damage or injury which is the result of adverse weather conditions, riot, war, strikes or other matters beyond the control of the Owner Any loss, damage or inconvenience caused or suffered by the Client if the property shall be destroyed or substantially damaged before the start of the rental period from any cause.

12. Under no circumstances shall the Owner's liability to the Client exceed the amount paid to the Owner for the rental period. This contract shall be governed by Scottish Law in every particular including formation and interpretation and shall be deemed to have been made in Scotland. Any proceedings arising out of, or in connection with, this contract may be brought in any court of competent jurisdiction in Scotland. Please note payment of deposit monies and/or payment in full signifies acceptance of these booking conditions by the Client. These terms will be available for the Client to read prior to making a booking and are available at all times on the web site.
